StarBella Spa – Terms of Service

1. Agreement to Terms
By visiting StarBella Spa, Inc. (“StarBella,” “we,” “us,” or “our”), booking an appointment, purchasing a product, or opting in to our text-message program, you (“you” or “Client”) agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not accept all Terms, please do not use our services.
2. Services & Medical Disclaimer
StarBella provides aesthetic, wellness, and medical-spa treatments under the supervision of licensed professionals. Information on our site, social channels, emails, or texts is educational only and not medical advice. Always consult your own healthcare provider. Outcomes vary by individual; no guarantee is made regarding results.3. Eligibility
You must be:
- at least 18 years old (or accompanied by a parent/guardian);
- legally able to consent to treatment;
- truthful on all health-history forms.
We may refuse or discontinue service if these requirements are not met.
4. Appointments, Payments, & Cancellations
You must be:
- Deposits & Pre-payments – Some services require pre-payment or a card on file.
- Pricing – Listed prices (including “$0” discovery visits) are subject to change without notice.
- Late / No-Show – Arriving >10 minutes late may shorten or forfeit your session; no-shows may be charged up to 100 % of the service fee.
- Refunds – Retail product returns accepted within 14 days if unopened. Service fees, injectables, and prepaid packages are non-refundable once rendered or partially used.
5. Promotions & Memberships
Discount banks, package rates, and promotional pricing are limited-time offers, non-transferable, and governed by the specific terms presented at purchase. We reserve the right to modify or discontinue any promotion at any time.
6. Text-Message Program (“SMS Program”)
StarBella uses SMS/MMS to send appointment reminders, promotional offers, and wellness tips.
Requirement Details:
- Opt-In Consent By providing your mobile number online, in-spa, or via “TEXT JOIN” keyword, you give express written consent to receive autodialed marketing and non-marketing texts from StarBella. Consent is not a condition of purchase.
- Message Frequency Varies; typically ≤8 msgs/month.
- Cost Message and data rates may apply.
- Opt-Out Reply STOP to 774-707-6215 at any time to cancel. A single opt-out confirmation text will be sent.
- Help Reply HELP or call 774-707-6215 for assistance.
- Carriers Carriers are not liable for delayed or undelivered messages.
- Data Use Numbers are stored securely, used only by StarBella, and never sold. See Privacy Policy for details.
We monitor TCPA, CTIA, and carrier guidelines and adjust practices to remain compliant. Abuse (e.g., spoofing) will result in immediate termination of access.
7. Health & Safety
You agree to:
- disclose relevant medical history, allergies, and medications;
- follow all pre- and post-care instructions;
- notify us immediately of adverse reactions.
We may photograph treatment areas for medical documentation; such images are kept confidential unless you sign a separate release.
8. Intellectual Property
All content, logos, and images on StarBella platforms are our property or used with permission. No reproduction, distribution, or derivative use is allowed without prior written consent.
9. Disclaimer of Warranties
Services and content are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
StarBella’s total liability to you for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages.
11. Indemnification
You agree to indemnify and hold StarBella, its owners, employees, and contractors harmless from any claims, damages, or expenses arising from (a) your breach of these Terms, (b) your misuse of our services, or (c) your violation of any law or third-party rights.
12. Dispute Resolution & Arbitration
Any dispute not resolved informally will be settled by binding arbitration in Middlesex County, Massachusetts, under the AAA Consumer Rules. You waive class-action rights. Either party may seek injunctive relief in court for intellectual-property misuse or unpaid fees.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, excluding its conflict-of-law principles.
14. Changes to Terms
We may update these Terms at any time. Material changes will be posted on our site with a new “Last updated” date. Continued use after changes constitutes acceptance.
